STUDENT LOYALTY PROGRAM - H.A.I.L." CONTEST

(The "CONTEST")

OFFICIAL RULES

NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.
A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

1. PERIOD: Contest begins at 12 p.m. Eastern Time (ET) on Thursday, August 23 and ends at 12 a.m. on Monday, April 15, 2013 (the "Contest Period").

2. ELIGIBILITY: Contest is open to all currently enrolled University of Michigan students, at least 18 years old at time of entry. Board members or executive officers of the University of Michigan, employees of the University of Michigan Athletic Department and any subsidiaries, affiliates, directors, advertising and promotional agencies of the University of Michigan Athletic Department, or the immediate family (spouse, parent, sibling, children, grandparent or grandchildren) and/or household members of any persons referenced in this paragraph are ineligible to participate.

To ensure compliance with NCAA rules, neither contest winners nor their guests may be a "prospective student-athlete" as defined by NCAA rules.

3. TO ENTER: Limit one (1) entry per person

(1). Download the HAIL Michigan Athletics Student Loyalty mobile application on your iphone or android device. OR sign up using an iPad at the H.A.I.L. Check-in Station at any home Michigan Athletics event. Register to be eligible for prizes by completing your mobile application profile, including full email address and UMID number.

(2). Alternate means of entry for Level Five Grand Prizes: Print your full name, date of birth, e-mail address, street address (including city, state and zip code) and day and evening telephone numbers on one side of a 3x5" index card; and mail it to: The University of Michigan Athletic Department, care of "Michigan HAIL Grand Prize" sweepstakes, 1000 S. State St., Ann Arbor, MI 48109.

Sponsor is not responsible for lost, late, ineligible, damaged or misdirected entries or any typographical or other errors in the entry, printing of the offer, administration of the Contest or in the announcement of the prize. Incomplete entry forms will be considered void.

4. SELECTION OF WINNER(S): Winners will be determined throughout the contest period by their individual point total. Grand Prize winners will be determined by random selection in Ann Arbor, Michigan on Wednesday, April 17, 2013 from among all eligible entries received. Where applicable, Winners will be notified by phone or e-mail. To be eligible to receive a Prize, Winner must comply with all terms and conditions of these Official Rules, and award of prize is contingent upon fulfilling all requirements. Prior to receiving Prize, Winners will be required to provide tax identification number and other information reasonably necessary to enable Sponsor to fulfill any tax reporting requirements and confirm in writing in a form reasonably required by Sponsor that Winner and/or Winner's guests meet the eligibility requirements of section 2, above. If a Winner cannot be contacted, or fails to provide the information referred to above or provide other information that may be required by law within the required time period, Winner shall be deemed to have forfeited the Prize. In the event that a Winner is disqualified for any reason, Sponsor will award a Grand Prize to an alternate Winner by random drawing from among all remaining eligible entries received. Odds of winning depend on the total number of eligible entries received during the Promotional Period.

5. POINT ACCUMULATION: Only contest events of University recognized Varsity Status Athletic Programs are point eligible, except where otherwise determined by Sponsor. All point values are subject to change and are at the sole discretion of Sponsor. Points will only be awarded to registered, eligible participants who attend events in full. Full Attendance is defined as checking in to an event (via the HAIL mobile application) no later than five (5) minutes into regulation play and leaving the same event only after regulation play has expired or when deemed appropriate by Sponsor. Full attendance is at the sole discretion of Sponsor.

6. PRIZE(S): The Contest Prizes are as follows:

DOWNLOAD PRIZE: Each new user/download of the HAIL Michigan Athletics Student Loyalty mobile application will receive one (1) coupon code for a discounted food item. (Approximate Retail Value, "ARV": $10)

PRIZE LEVEL ONE (12 POINTS): Upon reaching first twelve (12) points on their individual account, registered participant will be awarded one (1) t-shirt. (Approximate Retail Value, "ARV": $10)

PRIZE LEVEL TWO (25 points): Upon reaching first twenty-five (25) points on their individual account, registered participant will be awarded a one-time amount of $5 in University of Michigan Blue Bucks deposited directly to their student account. Registered user will also gain access to a list of discount offers from participating local vendors via the HAIL Michigan Athletics Student Loyalty mobile application. Specific offers, discount amounts, and participating vendors are under sole discretion of Sponsor.

PRIZE LEVEL THREE (50 points): Upon reaching first fifty (50) points on their individual account, registered participant will be awarded one (1) adidas shirt and one (1) adidas drawstring bag. (Approximate Retail Value, "ARV": $50)

PRIZE LEVEL FOUR (80 points): Upon reaching first eighty (80) points on their individual account, registered participants will be awarded a one-time grant of $100, to be deposited into a Flagstar checking account opened at any participating Flagstar Bank location.* Sponsor reserves the right to substitute a gift card of equal or lesser value. All registered participants reaching 80 points also receive one (1) University of Michigan Victors Club Priority Point awarded directly to student's account. (Approximate Retail Value, "ARV": $200)

*Only open to the first 250 University of Michigan Students and official H.A.I.L. participants who have reached the 80 point level. $50 is needed to open the account and must be opened with money not on deposit with Flagstar Bank. The $100 cash bonus will be paid 60 days after account opening. The SimplyChecking account needs to remain active for 180 days or an early account closing fee will be assessed along with a $100 bonus repayment. This offer cannot be combined with any other checking offers. This offer is limited to one per student. For tax purposes, the customer will receive a 1099-INT form from Flagstar. PRIZE LEVEL FIVE (100 points): Upon reaching or exceeding one hundred (100) points on their individual account, registered participant will receive an invitation to a private Michigan Athletics event. Event date, time, and location are at sole discretion of Sponsor. Registered user will also be automatically entered to win one (1) of the below listed Grand Prizes.

  • GRAND PRIZE ONE: One (1) winner will receive one (1) set of student season tickets for each of the 2013-14 Michigan Football, Men's Basketball, and Ice Hockey seasons. (Approximate Retail Value, "ARV": $650)
     
  • GRAND PRIZE TWO: One (1) winner will receive one (1) hour of William Davidson Player Development Center Court Time. Time and date of court time must be mutually agreed upon by both Sponsor and Michigan Basketball. Winner and up to nine (9) guests will be granted temporary access to the Player Development Center for one and one half hour on mutually agreed upon date and must be accompanied by an appointed member of Sponsor's staff. All winner guests must be registered students of the University of Michigan.
     
  • GRAND PRIZE THREE: One (1) winner will receive a sixty (60) minute photo shoot in and around Michigan Stadium (including Michigan Stadium Field). Time and date of photo shoot must be mutually agreed upon with Sponsor. (Approximate Retail Value, "ARV": $500)
     
  • GRAND PRIZE FOUR: One (1) winner and one (1) guest will receive lunch with Athletic Director Dave Brandon at a mutually agreed upon time, date, and location.
     
  • GRAND PRIZE FIVE: One (1) winner will receive fifty-two (52) vouchers for a FREE twelve-pack of Coca-Cola Zero to be redeemed at any participating vendor. (Approximate Retail Value, "ARV": $210)
     
  • GRAND PRIZE SIX: One (1) winner will receive a one-time amount of $2,000. (Approximate Retail Value, "ARV": $2,000)
     
  • GRAND PRIZE SEVEN: One (1) winner will receive two round trip airline tickets in the amount of two (2) $500 credits to anywhere in the continental US. All rules, regulations, and restrictions of the providing airline apply. (Approximate Retail Value, "ARV": $1,000)

BONUS PRIZE ONE (Highest Point Earner): The registered user earning the highest total of individual points via the HAIL Michigan Athletics Student Loyalty mobile application as of Monday, April 13, 2013 at 12 a.m. will be deemed the "Highest Point Earner." Winner will receive individual recognition during a 2013 Michigan Football home game. Home game date is at the sole discretion of Sponsor. In the event of a tie between two or more registered, eligible participants, the procedure for determining a winner will be at sole discretion of Sponsor.

BONUS PRIZE TWO (All Sport Attendee): Upon attending (in full) one regular season home event from at least 22 University of Michigan Varsity Athletic Programs registered participant will receive one (1) $100 Gift Card to MDen. Full Attendance is defined as checking in to an event (via the HAIL mobile application) no later than five (5) minutes into regulation play and leaving the same event only after regulation play has expired or when deemed appropriate by Sponsor. Full attendance is at the sole discretion of Sponsor.

BONUS PRIZE THREE (Early to all Football Games): Each registered user who check-ins to at least twenty 20 minutes prior to each scheduled game time, and attends in full, every 2012 Michigan Football home game will receive priority access to purchase student tickets to applicable post-season contests. "Priority Access" is at the sole discretion of Sponsor, will be established by the University of Michigan Ticket Office, and will be communicated via email.

BONUS PRIZE FOUR (Early to all Hockey Games): Each registered user who check-ins at least twenty (20) minutes prior to each scheduled game time, and attends in full, every 2012-13 Michigan Ice Hockey home game will receive priority access to purchase student tickets to applicable post-season contests. "Priority Access" is at the sole discretion of Sponsor, will be established by the University of Michigan Ticket Office, and will be communicated via email.

BONUS PRIZE FIVE (Early to all Men's Basketball Games): Each registered user who check-ins at least twenty (20) minutes prior to each scheduled game time, and attends in full, every 2012-13 Michigan Men's Basketball home game will receive priority access to purchase student tickets to applicable post-season contests. "Priority Access" is at the sole discretion of Sponsor, will be established by the University of Michigan Ticket Office, and will be communicated via email.

Official Winner(s) will be responsible for all federal, state and local taxes and fees and all other expenses associated with Prize receipt and/or use that are not expressly included in the Prize description, including but not limited to transportation to and from the University of Michigan. No cash or other substitution, assignment or transfer of any prizes permitted, except by Sponsor, who reserves the right to substitute Prize or prize component with cash or another prize of comparable or greater value.

7. SELECTION OF GROUP WINNER(S): Winning groups will be determined by maintaining the highest average point per member within their group category (Greek Life, Varsity Athletic Teams, Club Sports Teams, & Intramural Sports Teams). Average points per member will be calculated by the sum of all points earned by participants denoted as group members in the H.A.I.L. mobile application, divided by the total number of members listed on official rosters filed with the University. Winners will be determined on Wednesday, April 17, 2013 from among all eligible entries received. (Winners for the Intramural Sports Team category will be chosen prior to the Fall II, Winter I, and Winter II seasons). Where applicable, winners will be notified by phone or e-mail. To be eligible to receive a Prize, Winner must comply with all terms and conditions of these Official Rules, and award of prize is contingent upon fulfilling all requirements. Prior to receiving Prize, Winners will be required to provide tax identification number and other information reasonably necessary to enable Sponsor to fulfill any tax reporting requirements and confirm in writing in a form reasonably required by Sponsor that Winner and/or Winner's guests meet the eligibility requirements of section 2, above. If a Winner cannot be contacted, or fails to provide the information referred to above or provide other information that may be required by law within the required time period, Winner shall be deemed to have forfeited the Prize. In the event that a Winner is disqualified for any reason, Sponsor will award the Prize to an alternate Winner who will be the group with the next highest average point in the applicable category. Odds of winning depend on the total number of eligible entries received during the Promotional Period.

8. GROUP PRIZE(S):

GREEK LIFE PRIZE: One (1) winner will receive their choice of one (1) "Athletics Experience" from a list provided by sponsor. Athletics Experiences may include but are not limited to one (1) hour of field time at Michigan Stadium, one (1) hour of court time at the William Davidson Player Development Center, and two (2) hour use of Junge Champions Center. Sponsor reserves the right to add or remove item(s) from the Athletics Experiences list at any time. Time and date of prize redemption must be mutually agreed upon with Sponsor.

CLUB SPORTS FIRST PRIZE: One (1) winner will receive a onetime deposit of $500 into their individual Club Gift Account. (Approximate Retail Value, "ARV": $500)

CLUB SPORTS SECOND PRIZE: One (1) winner will receive a onetime deposit of $300 into their individual Club Gift Account. (Approximate Retail Value, "ARV": $300)

CLUB SPORTS THIRD PRIZE: One (1) winner will receive a onetime deposit of $200 into their individual Club Gift Account. (Approximate Retail Value, "ARV": $200)

INTRAMURAL SPORTS PRIZE: One (1) winner for each of the Fall II, Winter I, and Winter II intramural sports seasons. One (1) winner for each season will receive one (1) paid entry into the intramural sport of their choosing for up to $160 per season. (Approximate Retail Value, "ARV": $480)

VARSITY SPORTS PRIZE: One (1) winner will have their name inscribed on the H.A.I.L. trophy that lives in the Stephen M. Ross Academic Center.

No cash or other substitution, assignment or transfer of any prizes permitted, except by Sponsors, who reserve the right to substitute Prize or prize component with cash or another prize of comparable or greater value.

9. PRIZE RESTRICTIONS: All Prizes subject to availability. No substitution or cash equivalent of prize permitted, except at sole discretion of Sponsor. Sponsor may substitute a prize of equal or greater value. Sponsor may change the number of prizes awarded in its sole discretion. No prize transfers permitted, except at Sponsor's discretion. Official Winner is solely responsible for any expenses and any other costs not described as part of the prize. Federal, state and local taxes are the sole responsibility of Winner(s).

10. PUBLICITY/PRIVACY POLICY: Except where prohibited, participation in the Contest constitutes Winners' consent to Sponsor to use his/her name, likeness, photograph, voice, opinions associated with the event, hometown and state for promotional purposes in any media without further payment or consideration. Such publicity shall be conducted in accordance with all relevant University of Michigan policies.

11. GENERAL CONDITIONS: Sponsor reserves the right to cancel or modify the Contest if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Contest or the ability of Sponsor to award any prize as described herein, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the Prizes from among the eligible entries received up to the time of the impairment, or to cancel the Contest as deemed necessary to respond to the applicable impairment. Sponsor reserves the right in its sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules, or acting in any manner which violates University of Michigan policy or other applicable laws, rules or regulations. Any attempt by any person to deliberately damage any website, mobile application, or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

12. RELEASE/LIMITS OF LIABILITY: BY ENTERING THIS CONTEST, EACH ENTRANT AND WINNER AGREES TO RELEASE, DISCHARGE, AND INDEMNIFY AND HOLD HARMLESS, KARMA PROGRESSIVE, THE REGENTS OF THE UNIVERSITY OF MICHIGAN AND THEIR RESPECTIVE BOARD MEMBERS, OFFICERS, EMPLOYEES, SUBSIDIARIES, AFFILIATES, AGENTS AND REPRESENTATIVES FROM AND AGAINST ANY CLAIM, CAUSE OF ACTION OF ANY KIND OR OTHER LIABILITY FOR ANY DAMAGES, INJURY OR LOSSES OF ANY KIND, TO ANY PERSON RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY FROM ACCEPTANCE, POSSESSION, MISUSE OR USE OF ANY PRIZE OR PARTICIPATION IN ANY CONTEST RELATED ACTIVITY OR PARTICIPATION IN THIS CONTEST, INCLUDING WITHOUT LIMITATION PERSONAL INJURY, DEATH, AND/OR PROPERTY DAMAGE, AS WELL AS CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY.

13. DISPUTES: Each entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the courts of appropriate jurisdiction in the state of Michigan; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and (iii) under no circumstances will entrants be permitted to obtain awards for and entrants hereby waive all rights to claim punitive, incidental and consequential damages and any other damages (other than for actual out-of-pocket expenses) and any and all rights to have damages multiplied or otherwise increased.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.

15. WINNER'S LIST: The names of the Official Winners will be posted on MGoBlue.com/hail.
